Terms of Use for Bite IQ

Welcome to Bite IQ, operated by Lab&Co. These Terms of Use ("Terms") govern your access to and use of the Bite IQ mobile application ("App") available on Android and iOS platforms.
1. Acceptance of Terms
By using Bite IQ, you agree to be bound by these Terms. If you do not agree, do not use the app.
2. Eligibility
There is no strict minimum age requirement; however, users must comply with applicable local laws regarding app usage. Bite IQ may impose rate limits on usage depending on user activity.
3. User Content
Users retain ownership of the photos they upload. By submitting a photo, you grant Lab&Co. a temporary, limited license to process the image using AI services solely for providing functionality within the app.
4. AI and Nutritional Information
Bite IQ uses AI to provide food recognition and nutrient estimation. This information is intended for informational purposes only and should not be considered medical advice. Consult a qualified healthcare provider for personalized nutritional or medical guidance.
5. Subscriptions and Billing
Bite IQ offers auto-renewing subscriptions via the Apple App Store and Google Play Store. Subscriptions are billed to your Apple ID or Google account and automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time in your account settings on the respective store. Prices may vary by region. Subscriptions do not transfer between platforms. Lab&Co. does not handle payment data directly.
6. Intellectual Property
All content within the app—excluding user-submitted photos—including design, code, logos, and trademarks are the property of Lab&Co. and protected under applicable intellectual property laws.
7. Modifications and Termination
Lab&Co. reserves the right to modify, suspend, or discontinue the app or any part of the services at any time without notice. You agree that continued use of the app constitutes acceptance of any future modifications to these Terms.
8. Limitation of Liability
Lab&Co. is not liable for any damages arising from the use or inability to use the app, including reliance on AI-generated content.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of Poland.

Appendix: Apple End User License Terms
This End User License Agreement (“EULA”) is between you and Lab&Co. only, not with Apple Inc. (“Apple”), and Lab&Co. is solely responsible for the Bite IQ app and its content.
- Scope of License: The license granted to you is a limited, non-transferable license to use Bite IQ on any Apple‑branded product that you own or control, as permitted by the App Store Terms of Service. The app may not be distributed or made available over a network where it could be used by multiple devices at the same time.
- Maintenance and Support: Apple has no obligation whatsoever to provide any maintenance or support services with respect to the app. Lab&Co. is solely responsible for providing such support if required.
- Warranty Disclaimer: To the extent any warranty exists, Lab&Co. shall be solely responsible for it. Apple has no warranty obligation with respect to the app, and any claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty shall be the sole responsibility of Lab&Co.
- Product Claims: Lab&Co., not Apple, is responsible for addressing any claims of you or any third party relating to the app or your possession and/or use of the app, including but not limited to product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
- Intellectual Property Rights: In the event of any third‑party claim that the app or your possession and use of the app infringes that third party’s intellectual property rights, Lab&Co. will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Legal Compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third‑Party Beneficiary: You acknowledge and agree that Apple and Apple’s subsidiaries are third‑party beneficiaries of this EULA and, upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third‑party beneficiary.
